SMS Messaging Terms & Compliance

1. Program Description: This messaging program sends text messages to clients and consumers who have expressly opted in to receive SMS communications from MQ Realty Group, LLC. Messages include appointment confirmations and reminders, listing information, property listing alerts, and marketing messages about our real estate services.
2. How to Opt In: You may opt in to receive SMS messages in any of the following ways: (a) by checking the SMS consent box on a form on our website, www.mqrgroup.com; (b) in person, by signing or confirming your consent with one of our representatives; or (c) by phone, by verbally consenting when speaking with us. By opting in through any of these methods, you agree to receive text messages from MQ Realty Group, LLC at the mobile number you provided.
3. Cancellation Instructions: You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
4. Support Information: If you experience issues with the messaging program, reply with the keyword "HELP" for more assistance, or reach out directly to info@mqrgroup.com or call 954-933-4663 during business hours.
5. Carrier Liability: Carriers are not liable for delayed or undelivered messages.
6. Message & Data Rates: Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on your service usage, appointment schedule, listing alerts, and marketing programs you have opted in to. For questions about your text plan or data plan, contact your wireless provider.
7. Supported Carriers: Our SMS program works with all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, and most regional carriers.
8. Age Restriction: You must be 18 years or older to participate in our SMS program.
9. Privacy Policy: For privacy-related inquiries, please refer to our Privacy Policy.

We comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and CTIA guidelines, regarding the use of SMS communications. Consent to receive marketing text messages is not a condition of purchasing any property, goods, or services, or of entering into a real estate brokerage relationship with us.

General Terms

MQ Realty Group, LLC is a licensed Florida real estate brokerage providing residential and commercial sales and leasing services throughout the State of Florida. Information on this Site is provided for general information about our brokerage and about properties listed for sale or lease. Using this Site, submitting a form, requesting a valuation, or signing up for property alerts does not, by itself, create a brokerage, agency, or other professional relationship with us. Any such relationship is created only by a separate written agreement signed in accordance with Florida law.

Our Limited License to You

This Site and all the materials available on the Site are the property of MQ Realty Group, LLC and/or our affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal, non-commercial use.

You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us.

Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any material from the Site. Property Listings, MLS, and IDX Disclaimer

Property listing information displayed on this Site is provided in part through Internet Data Exchange (IDX) programs of the multiple listing services in which we participate, including MIAMI Association of REALTORS, BeachesMLS, and Stellar MLS. Listing data is provided by the listing brokers and the applicable MLS.

The information provided by this website is for the personal, non-commercial use of consumers and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing or leasing. Data is deemed reliable but is not guaranteed accurate by the MLS or by MQ Realty Group, LLC. Properties listed may be listed by brokers other than MQ Realty Group, LLC.

Listing prices, availability, dimensions, features, and other property details change frequently and may contain errors or omissions. You should independently verify all property information — including price, availability, square footage, lot size, school assignments, taxes, and fees — through your own inspection and with the listing broker before making any decision or entering into any transaction.

Home Valuation and Property Alerts

Our Site offers a home valuation form and property alert sign-ups. Any valuation, estimate, or market figure generated through the Site is an automated estimate provided for general informational purposes only. It is not an appraisal, a broker price opinion, or a guarantee of the price at which a property will sell or lease, and it is no substitute for an appraisal prepared by a licensed appraiser or advice from a licensed real estate professional who has inspected the property.

Property alerts are generated from MLS listing data and are sent only while your alert is active and matching properties are available. Alert frequency and content depend on the criteria you select and on the availability of MLS data.

Throughout the Site, we may provide links and pointers to Internet sites maintained by third parties. Our linking to such third-party sites does not imply an endorsement or sponsorship of such sites or the information, products, or services offered on or through the sites.

No Online Payments or Online Commerce

MQ Realty Group, LLC does not sell products through this Site and does not accept or process payments through this Site. Any fees, deposits, commissions, or other amounts owed in connection with a real estate transaction are handled separately, outside this Site, under the terms of the applicable written agreement, listing, lease, or sales contract, and in accordance with Florida law.

If the Site links to a third-party vendor or service, your dealings with that third party are solely between you and the third party. MQ Realty Group, LLC shall not be responsible for any loss or damage incurred as a result of such dealings.

Registration & Passwords

To access certain features of the Site, such as property alerts, you may be required to register and create an account, or to provide your name, email address, and phone number through a form. You agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account.

If you suspect unauthorized use of your account, notify us immediately at info@mqrgroup.com. We are not liable for any loss or damage arising from your failure to comply with this obligation.

Termination

We reserve the right to terminate or suspend your access to the Site, without notice, if we determine that you have violated these Terms of Service or engaged in conduct that we deem inappropriate or unlawful. Upon termination, you must cease all use of the Site and any content obtained from it.

Governing Law, Mediation, and Binding Arbitration

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida.

Informal Resolution and Mediation First: Before starting arbitration, the party raising a dispute, claim, or controversy arising out of or relating to these Terms of Service or your use of the Site must give the other party written notice describing the dispute. The parties will then attempt in good faith to resolve the dispute informally, and if it is not resolved within 30 days after that notice, the parties will attempt to resolve it through mediation in Broward County, Florida, administered by a mutually agreed mediator in accordance with applicable Florida law. Neither party may start arbitration until this informal and mediation step has been completed, except as provided in the carve-outs below.

Binding Arbitration: If the dispute is not resolved through the informal and mediation step above, it shall be resolved exclusively through binding arbitration in Broward County, Florida, administered in accordance with applicable Florida law, and judgment on the arbitration award may be entered in any court of competent jurisdiction. By agreeing to these Terms, you waive any right to a jury trial or to participate in a class action in connection with such disputes, to the fullest extent permitted by law.

Carve-Outs: Nothing in this section prevents either party from (a) bringing an individual claim in small claims court in Florida where permitted, instead of proceeding through mediation or arbitration, or (b) seeking injunctive or other equitable relief from a court of competent jurisdiction.

This section governs disputes relating to these Terms of Service and your use of the Site. It does not change the dispute process, if any, stated in a separate listing, lease, purchase, or other written agreement for a real estate transaction.
